Article 1 – Definitions

In these terms and conditions the following definitions apply:

Seller:
SanitairLuxe, trading via the webshop, based in the Netherlands, registered with the Dutch Chamber of Commerce under number 85028940, VAT number NL863478608B01.

Customer:
Any natural person or legal entity that enters into an agreement with the seller.

Consumer:
A customer who acts for purposes outside their business or professional activity.

Agreement:
Any agreement between the seller and the customer relating to the purchase of products and/or services.

Products:
All sanitary products, bathroom vanity units, made-to-measure items, tiles, flooring and related items offered by the seller.

Article 2 – Applicability

These terms and conditions apply to all offers, orders and agreements between the seller and the customer. By placing an order, the customer confirms that they agree to these terms and conditions.

Deviations are only valid if they have been agreed in writing.

Article 3 – Offers and prices

All prices are stated in euros and include VAT, unless otherwise indicated. Any shipping and delivery costs are stated separately.

Obvious errors or mistakes, including incorrect prices or inaccurate product information, do not bind the seller.

Article 4 – Formation of the agreement

The agreement is formed at the moment the seller confirms the order or as soon as payment has been successfully received.

Article 5 – Payment

Payment must be made in full before the products are delivered. Payment can be made using the payment methods offered in the webshop.

Article 6 – Delivery and transfer of risk

Delivery times are indicative. No rights can be derived from stated delivery times.

Delivery takes place via external carriers. In consumer sales, the risk of loss or damage passes at the moment the products are received by the consumer or by a third party designated by them.

Article 7 – Right of withdrawal (consumers)

The consumer has the right to cancel the agreement within 30 days of receipt, without giving any reason. The seller therefore applies a longer cooling-off period than the statutory period of 14 days. After cancellation, the consumer has a further 14 days to return the product.

The consumer must handle the product and its packaging with care. The costs of return shipping are always for the consumer's account, including in the case of an incorrect, defective or damaged delivery.

After a valid cancellation, the purchase amount will be refunded within 14 days of receipt and inspection of the return, using the same payment method.

Article 8 – Exclusion of the right of withdrawal

The right of withdrawal does not apply to made-to-measure products and products manufactured to the customer's specifications, specially ordered products, used or installed products, incomplete products and hygiene products whose seal has been broken.

Article 9 – Warranty

Products are covered by a 2 to 5 year warranty, depending on brand and product (see the product page). The consumer's statutory rights remain fully in force.

The warranty becomes void in the event of improper use, incompetent installation, damage, modification or normal wear and tear.

Article 10 – Liability

The seller is not liable for indirect damage, consequential damage or loss of profit. In all cases, liability is limited to the amount paid by the customer for the order in question.

The seller is not liable for damage caused by incorrect installation or assembly by the customer or third parties.

Article 11 – Force majeure

The seller is not required to fulfil obligations if a situation of force majeure arises, including but not limited to supply problems at suppliers, transport problems, strikes, government measures or other circumstances beyond the seller's control.

Article 12 – Complaints

Complaints must be reported in writing within 30 days of discovery via info@sanitairluxe.nl

The seller will confirm receipt of the complaint within 5 working days and aims to respond substantively within 14 days.

Article 13 – Privacy

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). More information can be found in the webshop's privacy statement.

Article 14 – Applicable law and disputes

Dutch law exclusively applies to all agreements. Disputes will preferably be resolved through mutual consultation and, if necessary, submitted to the competent court in the Netherlands.
